Motion that the Board of Supervisors convene in closed session with the City Attorney for the purpose of conferring with, or receiving advice from, the City Attorney regarding the following litigation against energy generators and traders for price gouging and market manipulation in which the City and County of San Francisco is a plaintiff:
PEOPLE v. DYNEGY, et al.
San Diego Superior Court No. 318189, filed 1/18/01, and now consolidated as
WHOLESALE ELECTRICITY ANTITRUST CASES I & II
U. S. District Court Nos. 02 CV 0990-RHW, and 02 CV 1000-RHW (Southern District of California)
The Closed Session is permitted by California Government Code Section 54956.9 (a) and Administrative Code (Sunshine Ordinance) Section 67.10 (d) (1), and discussion in open session concerning these matters would likely and unavoidably prejudice the position of the City in the pending litigation.
