Motion that the Board of Supervisors convene in closed session with the City Attorney for the purpose of conferring with, or receiving advice from, the City Attorney regarding anticipated litigation (City anticipated to be a plaintiff) which may be filed for the purpose of joining in litigation intended to direct responsibility for lead poisoning liability upon companies and industries that have used lead in their products and concealed the dangers of lead-based paint from the government and the public. The litigation that the City may join is:
County of Santa Clara v. Atlantic Richfield, Lead Industries, Association, American Cyanamid, Du Pont De Nemours and Company, The O'Brien Corporation, The Glidden Company, NL Industries, Inc., SCM Chemicals, The Sherwin-Williams Company, et al. Santa Clara County Superior Court No. CV788657, filed on March 23, 2000.
This closed session would be permitted by Government Code Section 54956.9(c), and San Francisco Administrative Code Section 67.10(d).
